‘No Fault’ Divorce

‘No Fault’ Divorce

On the 6th April 2022 some quite important changes took place and were introduced under the Divorce, Dissolution and Separation Act 2020. This legislation has been a long time in the making and is a fundamental shift in the divorce process which aims to remove unnecessary conflict and ease stress on couples and children. The thought process behind the legislation is to end the need for couples to apportion blame for the breakdown of marriage and instead focus on the key practical decisions involving children and their finances – hence the reference to ‘No Fault Divorce’.

Resolution is a community of family justice professionals that has been in operation since 1982 and who believe that a non-confrontational approach to family law issues would produce better outcomes for separating families and their children. Resolution have been a strong advocate for this change in law and have provided a useful summary below of the impact.

In the unfortunate event that you are going through a separation it is important that you receive financial advice to set out the options available to you. The earlier that an adviser is involved in the advice process the more opportunity there is to discuss and consider the settlement. It is all too common that advisers are approached once the settlement has been agreed and there is little scope to make any changes with our input.

Our team at Absolute Sense have the expertise to look at your financial situation, and any settlement being proposed, and set out any thoughts and considerations surrounding both the current and future impact on your financial situation. We offer a free initial consultation and we can discuss any charges that may subsequently apply depending specific needs of the advice that you require. We always advocate receiving advice but specialist knowledge does come in particularly handy in situations of divorce.
